HURIWA Lauds Appeal Court for Halting Rivers Allocation Seizure

The Human Rights Writers Association of Nigeria (HURIWA) has commended the Appeal Court’s judgment overturning the Federal High Court’s order to seize Rivers State’s statutory allocation. The association described the ruling as a landmark decision safeguarding democracy, federalism, and judicial integrity in Nigeria.

The Appeal Court, in a verdict delivered by Justice Barka on December 13, 2024, declared that the Federal High Court lacked jurisdiction to entertain the suit. Justice Barka emphasized that the subject matter—the appropriation of state funds—fell within the jurisdiction of state courts. He also clarified that the mere inclusion of federal agencies in the case did not automatically empower the Federal High Court to preside over the matter.

HURIWA praised the judgment, calling it a vital step in preserving democratic principles and thwarting politically motivated attempts to destabilize Rivers State. In a statement signed by its National Coordinator, Comrade Emmanuel Onwubiko, HURIWA lauded the Appeal Court for reaffirming the independence of the judiciary and protecting the state’s governance structure.

    “The Appeal Court’s decision is not just a victory for Rivers State but a win for Nigeria’s constitutional democracy. It sends a clear message that the judiciary cannot be weaponized for political vendettas,” the statement read.

    HURIWA strongly condemned the pro-Wike group, accusing them of attempting to disrupt governance and sow chaos in Rivers State through frivolous legal actions. The association noted that the Federal High Court’s initial order would have plunged the state into financial turmoil and widespread anarchy.

    “The pro-Wike group’s attempt to seize Rivers State’s allocation was an act of sabotage aimed at crippling governance and inflicting hardship on the people. Such reckless actions, if unchecked, would erode the fabric of federalism and democracy,” Onwubiko remarked.

      The ruling has sparked celebrations across Rivers State, with citizens taking to the streets to applaud the Appeal Court’s intervention. HURIWA joined other civil society groups and the Opposition Lawmakers Coalition in acknowledging the significance of the verdict.

      HURIWA urged the judiciary to remain steadfast in upholding justice, emphasizing the need for judges to resist political pressure. “This judgment restores confidence in the judiciary. Judges must continue to defend the rule of law and democracy, remaining impartial and just,” the association stated.

      The association also took the opportunity to call out the pro-Wike group for their destructive tactics, labeling their actions as a disservice to Rivers State and the nation. “Using the judiciary to settle political scores is not only shameful but also detrimental to the people’s welfare. Such behavior must stop,” HURIWA asserted.
